About our Bellevile Process Server

Paul Haller began his policing career with the Ontario Provincial Police in 1975. Paul served from 1975 - 1986 in Kaladar, Ontario where his duties consisted of general investigations and patrol, along with being a member of the District #9 Search & Rescue unit.

In 1986 Paul was transfered to Belleville Detachment where he continued as assigned, to general patrol along with serving on the Search & Rescue Unit. He also was a trained Marine Operator and did a six month deployment with the Penitentiary Squad. In 2000 Paul was transfered to Central Hastings Detachment (Madoc). While there he was assigned to the Court Case Management Position for the Detachment until his retirement in 2006. This position consisted of managing all facets of the Detachments Court files, which meant the proofing of all briefs, attending Pre-trial meetings with lawyers and judges, setting trial dates etc.

Paul was involved with the Ontario Provincial Police Association serving as Branch 9 Treasurer for a number of years and then as Branch Secretary from 2001 - 2006.

On November 21 and 22, our representative Rose attended the County of Carleton Law Association's Civil Litigation conference in Montebello, Quebec. On Friday June 6, Canadian Process Serving Inc exhibited at a trade show connected to the County of Carleton Law Association's Family Law Conference. Today is the first day of the ILCO conference at the elegant White Oaks Resort in historic Niagara-on-the-Lake. Canadian Process Serving Inc's table is a number one destination for the attendees, as our relationship with this organization is of long standing.

Rose, who is representing CPS at the trade show, spent most of the morning giving away bags and other merchandise and bringing both existing and new clients up to date on the progress the company has made over the last year. Process serving for the Hamilton Law Association

On April 23, Canadian Process Serving Inc exhibited at the Hamilton Law Association trade show. Rose and Sandra, the company reps who manned our booth, gave away our popular bags, pens, and stationery. Prospective new clients were intrigued at the sheer volume of process serving offices that we can place at their disposal, and regular clients made a point of telling us how much they appreciated the assistance we have rendered in the past.

We were particularly pleased to meet Mr. Wayne Snyder of Madorin Snyder LLP, who advised that the litigation support we have provided to his office over the years has been considerable. Since Madorin Snyder is one of our best clients, this praise was sincerely appreciated. Rose and Sandra also met lawyers from Pallet Vallo LLP, Ross & McBride, Stanley Tick and Associates, and other valued clients.

Process Servers vs. Bailiffs

One question we frequently get over the phone and during in-person appearances at trade shows is "We need a vehicle repossessed / party evicted. Can your company take care of this for us?" When we explain that we are process servers, not bailiffs, we sometimes get this followup question: "What's the difference?"

Process Servers give legal notice to a party requiring them to respond to a proceeding scheduled to be held before a court, government body, or tribunal. Our men and women do not enforce judgements: we don't seize property or evict tenants, although we do serve the initial notice of such pending actions. We also attend court to issue and file documents on a client's behalf, and conduct litigation searches as requested.

Bailiffs can also serve process, which leads to the aforementioned confusion. In some Canadian jurisdictions, baillifs perform repossessions and evictions in accordance with court judgments, apply wheel clamps and execute arrest warrants. In Ontario, provincial bailiffs also transport prisoners between correctional facilities. Under the Ministry of Correctional Services Act (Ontario), while transporting prisoners, bailiffs have the powers of police constables.

Doing your own divorce

Are you a private individual handling your own divorce particulars, including service of the issued Application for Divorce? If so, Canadian Process Serving Inc has over 100 process servers, all of them former police officers, who can handle the actual service of the papers for you.

To hire one of our servers, please download and print out this Private Individual checklist. Canadian Process Serving Inc requires a $200 retainer to be paid up front via certified cheque, money order, or credit card. We deduct the fees for your service from this retainer and refund you the balance if one remains.

If paying by credit card, please call 1-800-465-7378 and have your credit card number ready. We will debit your card for the required amount and provide you with an authorization number that must be mentioned in your letter of instruction to the process server- for example ‘Retainer paid by Visa, authorization no. XXXXX’.

Ontario Small Claims Court Forms

Effective July 1, 2008, a new Affidavit of Service for Small Claims Court documents will be in use. This affidavit is much more extensive, and presents additional options based on manner of service.

The story below was taken from an article titled “Writer Fights Judgment” published in January, 1940 in the Los Angeles Times.

With all the strength at his command, Gordon Ray Young, veteran motion-picture writer, yesterday tried to throw off the burden of a $43,371 judgment which he contends would not have fallen on him but for a process server’s ruse.

The writer asserts that not long before Christmas, a Mrs. Gertrude Mallon called at his home, insisting that he read a manuscript of which she presented herself as the author. When he protested that he lacked the time, Young adds, Mrs. Mallon dropped a bundle of papers at his feet and departed, remarking that she would take a chance on his reading it later.

It was not until he was notified that his home and other property had been subjected to liens that Young discovered that the ‘manuscript’ that he kept unopened was really summons in two lawsuits filed against him over the flood of March 1939.

In asking that the court set aside the judgments, Young insisted that he had a valid defense and that he had never been given the proper opportunity to present such defense because of the process server’s asserted ruse.

Hiring one of our process servers

Do you need to hire a process server but aren't quite sure how to go about doing it? Canadian Process Serving Inc can help. Just read our FAQ below.

How much does it cost to hire one of your process servers?
That depends on how many attempts are made, as well as the corresponding mileage. Miscellaneous charges that could also apply are faxing, photocopying, long distance charges, and notary fees. Canadian Process Serving Inc requires a $200.00 retainer from all private individuals requesting service of process, payable in advance by certified cheque, money order, or credit card. After service is completed, we deduct all costs from that $200.00 and refund any balance to you.

What do I need to do first?
First, get your documents from the court. Then go to www.canadianprocessserving.com and find out if we has an office covering the address where you want your papers served. You can do this by clicking on the ‘Search by Postal Code’ button. We occasionally list other process serving companies in places where we don’t have a corporate office. If the process server who’s closest to where you want your papers served is not one of our offices, then you will have to contact them directly and ask about their prices and document sending policies. -Once you’ve determined what Canadian Process Serving Inc office you need to send your papers to, send a completed Private Individual Checklist form along with your documents to the process server.

What do I need to send?-
We need the documents, the completed Private Individual Checklist, and either $200.00 certified cheque or money order. You may also pay the retainer by credit card beforehand.

How long will it take for my papers to be served?
If you’re asking us to serve a business or government agency for you, service of process can generally be accomplished quite quickly. But if we’re serving a person, how long it takes to complete the service really depends on how long it takes to catch the party at the address that you provide.

What happens after my papers are served?
Once your papers are served, the process server swears out an affidavit of service detailing when, where, and how he or she served your party. They will send this document directly to you so you can take it to the courthouse that created your file in the first place.

Can the cost for my service come to more than $200?-Hopefully not, but as you are billed for each attempt made, charges can add up if you request that the server keep trying.

What happens if the process server doesn’t get the party served?
In that event, the process server will give you an affidavit of attempted service, which will outline where, when, and how he or she attempted to serve your party, and why the attempts were not successful. You can take this to the courthouse that created your file, and request guidance on how to proceed.

If you break these laws you could be served

A surprising number of archaic laws are on the books in Canada. If you break any of them, you could find yourself confronted by a process server with a summons to appear in court!

You may not pay for a fifty-cent item with only pennies.
Citizens may not publicly remove bandages.
It is illegal for clear or non-dark sodas to contain caffeine.
Businesses must provide rails for tying up horses.
Wooden logs may not be painted.
When raining, a person may not water his/her lawn.
Margarine producers can’t make their margarine yellow.
If you have a water trough in your front yard it must be filled by 5:00 a.m
The color of house and garage doors is regulated by city bylaws (a purple door get you a fine).
You can’t work on your car in the street.

In Fort Qu'Appelle, SK, It is illegal for a teen to walk down the main street with their shoes untied.
In Calgary, it is unlawful to throw snowballs or set off firecrackers within the city, without the authorization of the mayor or City Council.
Theater owners are forbidden to start a movie that will end after 2 am in Toronto.
In Halifax, no citizen is allowed to chop wood on the sidewalk.
You are not allowed to wear a bathing suit while "loitering, playing or indulging in a sunbath" in any park or on the beach in Victoria, BC.
You are not allowed to wash your automobile in the street in Toronto.
It is illegal for children to eat ice-cream cones on the streets on the Sabbath in Ottawa.
You are not allowed to play a musical instrument in a park in Windsor, Ontario.
It is illegal to try and catch fish with your hands in Saskatoon, SK.
All bicycle riders must signal with the arm before making a turn, and a bicycle rider must keep both hands on the handlebars at all times" in Edmonton.
A by-law forbids anyone from striking the sidewalk with a metal object in Winnipeg.

Toronto process servers scandal

When you send your papers out for service, it's important that the company you hire be thoroughly familiar with the proper methods of process service.

In July 1960 an Ontario 'divorce mill inquiry' was launched after two bailiffs, R.J. Gray and Alan Fawcett, served papers in three actions, and used the photo of an innocent woman to identify the co-respondents. At that time, when process servers were sent to serve divorce papers, they were given a picture that was to be used as an identification aid. Court identification would subsequently be made by an affidavit swearing that the person in the photo and the person who received the summons were one and the same.

The three sets of papers were served using the same picture as a reference, alarm bells went off and both bailiffs were questioned by Inspector Herbert Purdy of the provincial police.

Dishonest service of process can be a law office's worst nightmare. The story below was taken from an article titled “Writ Server Trails Woman to Her Bath”, originally published in the New York Times on June 13, 1922.

Mrs. Robert W. Chambers, wife of the author, had a harrowing experience yesterday afternoon when, according to the police, a process server dashed upstairs with a maid screaming at his heels and served her with a subpoena as she emerged, from her bath, thinking the house afire.

Shortly after the man had fled, Mrs. Chambers missed a pearl necklace. The process server was arrested on charges of grand larceny and disorderly conduct. He denied having taken the necklace.

It was just after noon yesterday when the bell rang at the Chambers residence. The maid answered the bell and was confronted by a man who afterward said that he was David Hartman of Brooklyn. “I’m Mr. Lewis,” the man was quoted as saying, “I’ve got to see Mrs. Chambers at once. It’s very important.”

The maid told the caller that Mrs. Chambers was in her bath and therefore could not be asked to come down just then. “We’ll see about that!” was the answer. And before the maid could shut the door, the process server had shoved her aside and bounded upstairs. The maid stumbled, but quickly regained her footing and followed the intruder, screaming. Believing the girl must be in distress, Mrs. Chambers, naked, flung open the bathroom door and rushed out. The process server faltered, then jerked a subpoena from his pocket, flung it so that it hit Mrs. Chambers, and shouted, “There’s something for you!”

Then the invader turned and ran down the stairs. A few minutes later, the maid and Mrs. Chambers searched the house to make sure he was gone. They missed a necklace, valued at $2600, which they had been certain was lying on a table in the library on the second floor.

Experienced process server gets the job done

The story below was taken from an article titled “Confessions of a Hardened Process Server”, originally published in the Galveston, Texas daily paper in 1947.

The late Sarah Berhardt once taxed the utmost imaginative powers of process server George Thompson before he finally reached her. It was on one of her American tours and her temperamental whimsies had involved her getting into an altercation about a contract. Getting to Sarah was a task that stumped one expert server after another.

Thompson learned that Bernhardt wanted to buy a young lion to amuse her in her hours of relaxation. He hired a lion cub from the circus, then in winter quarters at Bridgeport, Connecticut. He brought it to New York and sent word up to Berhardt at her hotel that he had just the lion for her. He came in, leading the small animal, which was muzzled and growling.

“Ah!” sighed the whimsical lady. “The lovely lion cub!”

“Ah!” purred Thompson. “ah- the lovely process!” The papers were then tossed at her feet.

The next day Sarah’s attorneys went about settling out of court.

Service of process on celebrities is difficult but not impossible.

Alexander A. Lowande, a process server for Homer & Miller, lawyers, of 27 William Street in New York, was so energetic that he landed in the Night Court on February 2, 1910, charged with creating a disturbance in the Alhambra Theatre, at 126th Street and Seventh Avenue. He said he had simply tried to take the first step in notifying a dancer there that Frank C. Bangs, a photographer of 30 West 38th Street, wished to collect $52 for photographs supplied to her.

He had been trying to take that step for many days, and after being thrown from the steps of her hotel, stationed himself at the stage entrance one night, with a friend at the main entrance, and four other men in the body of the theatre. A little after 8:00 pm, word reached him that the woman had gone in the front way. He hatched a plan to serve the papers over the footlights.

This is what he did- or tried to do. But when the papers flew past the hot lights, they caught fire… and so did the stage. Then there was the manager to face, to say nothing of the assistant manager, the Treasurer, and the policeman who came running from the West 125th Street Station.

At the Night Court, he conducted his cross-examination on his own behalf, with the result that Magistrate O’Connor fined him $3.00.

Some hours later, Lowande told reporters that he had trailed the dancer to her hotel after the payment of his fine. The papers were served.

The story below was taken from an article titled “Husband In State of Siege”, published December 14, 1911, in the New York Times.

Supreme Court Justice Giegerich gave counsel for Mrs. Rosie B. Segall another chance yesterday to serve papers on Louis Segall, her husband. Segall is behind in his $15 a week alimony, his wife said, and she wants him put in Ludlow Street Jail. Three weeks ago she got an order compelling him to appear and show cause why he should not be punished for contempt of court for non-payment of the alimony.

Segall got wind of the order and barricaded his rooms at 118 Eldridge Street. The process servers could not get into the rooms. They tried the doors, but could not burst them in. They climbed the fire escape and found he had boarded up the windows. They came down the dumb-waiter shaft and found that he had a bolt across the dumb-waiter door, which he opened only on getting a code signal, which they did not know. How Segall has managed to exist in the apartment for so long puzzles Mrs. Segall’s attorney….”

Mr. Segall eventually emerged, and appeared in court, after weeks of treatment for malnutrition and lung problems resulting from poor ventilation.

The story below was taken from an article titled “Trials of Process Servers”, published March 8, 1903, in the New York Times. The interview subject owned one of the city’s most prestigious process serving companies.

“A woman process server is often a necessity. I have one attached to my office who is full of original ideas. One of her experiences was unique.

“She had been trying to serve papers on a lady living in the St. James Hotel…. The lady with her maid had two connecting rooms: a sitting room and a bedroom. No one could get past the sitting room, and the lady in question was always ‘ill’ or ‘sleeping’ in the bedroom while the maid stood guard.

“In the service of civil process, you have no right to break down doors or lay hands on people, and the maid always managed to position herself before the bedroom door.

“My server at last hit upon one of her happy ideas. She gained access to the sitting room as usual, and to the consternation of the maid, sat down. After a minute or so she opened her chatelaine bag, presumably to get her handkerchief, when out jumped four of the liveliest little mice you ever saw.

“Of course, my server played her part and shrieked. The maid shrieked. Some of the mice ran under the portiere into the bedroom. The lady (inside) shrieked. Pandemonium reigned. Out rushed her ladyship, who was promptly served.”

A great turn out! Even in minus 25 the lawyers made it out of their houses and law firms, into their cars and into the Fort Garry hotel, Winnipeg’s landmark Hotel and conference centre.
What was nice is that during the 2 hour lunch break in the exhibit hall they had Law Management through, the people in charge of what services their firms would use. It seemed every other person that visited me at our booth had something nice to say about our company, a story of successful service, a referral to the person next to them on our behalf or just a firm handshake thanking us for providing the nation wide services we do.
So if we weren't being patted on the back for a job well done we were being questioned by other interested parties looking for a reliable process server. As I handed them our most up to date office list they were astonished to find over 110 corporately owned offices across the nation, each one run by a former peace officer. When I mentioned our expansion into the United States they were again astounded to know that we could service their documents through over 70 different corporate offices in the U.S. (And all with just one number to call, one website to visit and a head office staff that is eager to help. )

The Manitoba Bar, as in years past, has proven an excellent event with a substantial number of attendees aware of our services and many more keen to know us.
